Bought a laptop from frys.com back in Sept’2011. Laptop was shipped by frys thru’ FedEx Smart Post (they are usually delivered at the door by USPS). I refused delivery of the package because item arrived after more than 10 days of ordering and I had already picked up something from BestBuy meanwhile. Tracking clearly shows “Delivery Exception: Delivery refused by recipient” and then that is the last tracking info available from FedEx web site. Usually it shows all the way until item is delivered back to the shipper address but not in this case. somewhere something lost in between (not sure at FedEx end or USPS end). Frys wasn’t responding to my calls on refund positively, they kept saying their team is investigating my claim. After 50 days, I finally had AMEX chargeback them. AMEX resolved it in my favor after few weeks of waiting because frys couldn’t prove the package was delivered to me. Now after all these months, I received a certified mail envelope from frys Risks department that I owe them the purchase amount + penalties within 10 days or else will refer me to collections or something like that…

How do I resolve this? I clearly refused delivery and I don’t mind paying back the shipping fee (that frys lost becos of me) back and forth. I have print-outs of everything to prove it wasn’t delivered and I had refused the shipment. Should I call their risks department OR send them copies of everything thru’ fax/certified mail? What is the best way to get this resolved? Thanks for all your help in advance.

Hi all,

I recently got a package that is severely damaged-outside and inside, delievered from FedEx.
It seems like the FedEx guy just threw it against a piece of rock and knocked it with a hammer 50 times- and I am not exaggerating. I had a piece of antique inside which is valued about 3000 dollars and now it’s basically all torn apart.

I can probably do a claim, or even sue FedEx, but the bad thing is I didn’t put down an insurance value when i had it shipped to me.
I wonder how FedEx will deal with if i file a claim for 3000 dollars though I didn’t purchase insurance? I know it was stupid of me to not put down a value, but nonetheless, i feel FedEx should take responsibility.

I also suspect that, they used a FedEx ground driver to pick it up instead of express, which is what I ordered. I heard the ground drivers are not as good and if that’s the case, would I be able to have more leverage on the claim/case?

Please advise what the best option is.Thanks a lot.
